1.Definitions
General Terms of Sale

The general terms of sale constitute the set of rules that will be applied to the purchase of Miniconf products (the "Products") through the website www.ido.it.
The General Terms of Sale are formulated in accordance with the regulations on contractsstipulated outside of business premises and, in particular, in accordance with the provisions of Legislative Decree n.70 of 9 April 2003 (Implementation of Directive 2000/31/EC regarding certain legal aspects of information society services in the internal market, with particular emphasis on electronic commerce) as well as of Legislative Decree no. 206 of 6 September 2005 (Consumption Code) and subsequent amendments and additions

Parties to the contract

The parties to the contract are as follows:
- Miniconf S.p.a., with legal offices in Ortignano Raggiolo 52010 (Ar), Via Provinciale 1/a, VAT no. 00249390519 - REA AR 64978.
- Customer, for the purposes of these General Terms of Sale, customer means thenatural person or other legal person who purchases products through the site www.ido.it.

2.Subject

2.1 The General Terms of Sale regulate the relationship between the customer and Miniconf S.p.a. for the purchase of products as they are made available on the website www.ido.it.
2.2 Miniconf S.p.a. reserves the right to modify the General Terms of Sale at any time, it being understood that those published on the website www.ido.it (the "Online Store") will be held applicable to the sales agreements between the customer and Miniconf S.p.A. ("Sales contracts") at the time of submitting product purchase proposals ("orders") by customers.
2.3 In case of conflict between the General Terms of Sale and any other terms and conditions related to the Sales Contracts published in the Online Store the terms and conditions most favourable for customers will be applied.
2.4 The Sales Contracts stipulated by accessing the website www.ido.it are governed by Italian law and specifically by Legislative Decree no. 70 of 9 April 2003 (Implementation of Directive 2000/31/EC regarding certain legal aspects of information society services in the internal market, with particular emphasis on electronic commerce) and by Legislative Decree no. 206 of 6 September 2005 (Consumer Code) and subsequent amendments and additions.

3.Site registration

3.1 Registration with "username" and "password" is optional but has the advantage of storing the historical record and traceability of orders. However, if customers do not wish to register, they can still complete the purchase through the Quick Check out procedure: in this case only the data necessary for shipping, delivery and payment of the order will be requested. The data and information received will be processed in compliance with the provisions of Regulation 2016/679 and subsequent amendments and additions - GDPR
3.2 Customers can register directly in the "MyiDO" section where, in addition to completing their purchase, they will find fashion and trend news. Registration in the MyiDO section will also entitle customers to free returns and free shipping for orders with delivery at the point of sale. Shipment is free of charge even for customers not registered with the site that request delivery to an iDO store. Data and information received will be treated in compliance with the provisions of Regulation 2016/679 and subsequent amendments and additions - GDPR

4.Stipulation of Sales Contracts

4.1 Miniconf S.p.a. undertakes to forward shipment confirmation (the “confirmation") of the order to customers within 3 working days from receipt of the orders from customers.
4.2 The Sales Contract shall be deemed stipulated between the parties when the customer receives confirmation of the order. If the customer does not receive the order confirmation within the term indicated in art. 4.1, the respective order shall be considered rejected by Miniconf S.p.a. and therefore without effect. Miniconf S.p.a. is not responsible for any malfunctioning dependent on the operator of the data transmission network.
4.3 By placing orders, customers acknowledge and declare that they have read all the information provided during the purchasing procedure and that they fully accept the General Terms of Sale as well having read all the other information contained in the On-Line Store.
4.4 Orders will be stored in the Online Store's database, according to the procedures and in compliance with the provisions of Regulation 2016/679 and subsequent amendments and additions - GDPR and may be accessed by contacting Miniconf S.p.a. as per art. 1, namely by accessing the folder relating to the customer's profile containing their personal information (the "Profile").

5.Product availability

5.1 Without prejudice to the provisions of art. 5.2, in correspondence with each product published in the Online Store, Miniconf S.p.a. shall indicate whether same:
(i) is available in its warehouses;
(ii) is not available in its warehouses;
5.2 All products are subject to current availability. Miniconf S.p.a. reserves the right at any time to change the type and availability of the products published in the Online Store without this involving any responsibility for Miniconf S.p.a. with regard to its customers.
5.3 The indication regarding the availability of products is not binding, it being understood that the products indicated as "not available" as per art. 5.1 (ii) cannot be ordered by customers. In case of unavailability of one or more products indicated as available at the moment a customer places an order, Miniconf S.p.a., notwithstanding what is provided for by art. 5.2, undertakes to give the customer timely communication by email, proposing an alternative if possible.In this case, notwithstanding the right of withdrawal referred to in art. 10 below, the customer will be able to integrate or confirm the order by replying to the email within 48 hours after receiving it. If no answer is received from the customer after 48 hours, Miniconf S.p.a. will proceed with the shipment of the available products. In case of payment by credit card or PayPal, Miniconf S.p.a. will process the payment at the moment of the order and unavailable products will be refunded immediately to the customer. In case of payment by bank transfer, Miniconf S.p.a. will take steps at the earliest to refund a sum equal to the value of the unavailable products.

6.Price and shipping costs

6.1 Product prices are expressed in € (euros). The applicable price is the price published in the On-Line Store at the time the orders are placed by customers.Miniconf S.p.a. constantly checks that all prices indicated in the On-Line Store are correct, but this does not guarantee the absence of errors. If a pricing error is made, Miniconf S.p.a. will give the customer the possibility to reconfirm the order as per the modalities of art. 5.3 above.
6.2 The price is inclusive of VAT.
6.3 The price does not include shipping costs. Miniconf S.p.a. reserves the right to request a contribution from customers for shipping costs that may vary depending on the type of delivery, quantity of products to be delivered, their volume, weight and destination.
6.4 The contribution Miniconf S.p.a. requests for shipping costs is indicated, separately from the price, before the order is placed by the customer and will be paid by the customer together with and at the same time as the price in accordance with the modalities set out in art. 8 below.
6.5 Any taxes, duties and other charges provided for by the laws of the State where the products are shipped and delivered will be entirely at the expense of the customer and paid by them at the time of delivery of the products, directly to the competent tax or customs authorities or to the courier in charge of the delivery.

7.Placing orders

7.1 To place an order, customers are invited to register with the Online Store, entering all "mandatory" data and choosing a password to use when placing orders and for accessing, their Profile, including at a later stage. Customers are able to place the order quickly using the Quick Check out procedure, which allows them to complete the purchase as guests of the site. To complete this procedure it is sufficient to enter name and surname, an email address, the delivery address of the products, a telephone number and the necessary payment information.
7.2 Customers may purchase products by selecting them in the section of the On-Line Store
dedicated to the type of product in question and adding them to the "cart". If customers intend to purchase more than one product, the same procedure as above should be repeated by clicking on "add more products". Once the choice of products has been completed, customers must, if they have not already done so, proceed to register as per art. 3 or, if already registered, authenticate themselves by entering email address and password in the appropriate fields and clicking on "Complete the purchase!".
Alternatively, customers who do not intend to register with the site can select the Quick check out option where they just need to enter their first and last names, an email address, the product delivery address, a telephone number and the information necessary for the payment. After verifying the correctness of the data about the chosen product(s) and the "sending information", customers must choose the method of payment as per Art. 8 below. Having chosen the payment method, customers can proceed to place their orders by clicking on "Place your order".

8.Payments

8.1 I Customers can make payment for the products selected and the contribution for the shipping costs as per art. 6 by credit card, PayPal, MyBank, bank transfer and cash on delivery. Miniconf S.p.a. reserves the right at any time to modify the means of payment used by customers, it being understood that the prices published in the Online Store at the time the customer places the order are considered to be usable.
8.2 In case of payment by credit card, customers will be charged with the price of the products selected and the contribution for shipping costs as per art. 6, after credit card data has been verified and after having received charging authorisation from the Banca Sella, at the same time as Miniconf S.p.a. sends the order confirmation. The credit card data sent during execution of the orders are protected and are sent directly to Banca Sella. The payment is made directly on a secure server, with SSL encryption key so as to guarantee the absolute security of the transaction. Credit card details are not accessible to Miniconf S.p.a or in any case to third parties, either at the time the orders are placed or afterwards.
In order to make the online credit card transaction safer, customers will be required to enter their secure code, failing which the transaction cannot be accepted.
8.3 In case of payment by PayPal, at the time orders are placed by customers, the web session is transferred to PayPal's secure website. On that website, customers can make payment of the price and shipping cost contribution referred to in art. 6 using their PayPal account and in compliance with the conditions of use of the PayPal service subscribed by customers at that time or previously.
The price and the contribution for the shipping costs will be charged to the customer’s PayPal account at the same time as Miniconf S.p.a. sends the order confirmation.
8.4 In case of payment through MyBank, customers can make an instant transfer directly through their Online Banking system. The customer will be directed to the Banca Sella page dedicated to payments through MyBank and there will be able to select their own reference bank.
8.5 In case of payment by bank transfer, customers must make the transferto the bank indicated in the On-line Store, indicating as the reason the order number
communicated by Miniconf S.p.a. at the time of sending the order confirmation. The goods are sent to the customer only upon receipt of the bank transfer
8.6 In case of payment by cash on delivery the goods normally leave within 3 days.
from receipt of the order, and upon the arrival of the package the customer pays the courier the amount of the order. This service has a surcharge of € 7.00. The cash-on-delivery expenses will be shown in the order confirmation.
The cash on delivery payment method cannot be used for orders with delivery at the point of sale. For orders with delivery at the point of sale the payment methods accepted on the www.ido.it site are only bank transfer, credit card, MyBank and PayPal.
8.7 The moment the order has been placed, Miniconf S.p.a. will send the customer the order confirmation, as an attachment to the shipment confirmation email to the address given by the customer at the time of the order. If the customer needs an invoice, their Tax Code number should be entered before completing the purchase if they are a private customer, or the VAT number in the case of a company, and the SDI code. For the purposes of issuing the invoice, the information provided by the customer shall prevail. No change in the invoice will be possible after it has been issued by Miniconf S.p.a.
8.8 The information received by Miniconf S.p.a. will be used exclusively to complete the procedures pertaining to the sale of products and for the refund procedures in case of the customer exercising the right of withdrawal as per art. 10. The data and information received will be handled in compliance with the provisions of regulation 2016/679 and subsequent amendments and additions - GDPR

9.Shipping and Delivery of Products

In the Italian version of the website www.ido.it it is only possible to buy from Italy and deliverproducts in Italy.
9.1 Given that "shipping" of the products by Miniconf S.p.a. means delivery of the same to the couriers as selected, Miniconf S.p.a. is not obliged to ship the Products until it has received the payment due; once said payment has been received, Miniconf S.p.a. undertakes to ship the products:
(i) in the case of available products (as defined in art. 5):
- within 3 working days from receipt of the debit authorisation communication as per art. 8.2 in case of payment by credit card;
- within 3 working days from the moment in which the payment information has been made available to Miniconf S.p.a. in case of payment by means other than a credit card;
(ii) if a product indicated as available at the time the order is placed proves to be unavailable, Miniconf S.p.a. undertakes to inform the customer by email or telephone, proposing an alternative if possible.
In this case Miniconf S.p.a. will give the customer the possibility of confirming or integrating the order according to the modalities of art. 5.3 above.
9.2 Miniconf S.p.a. guarantees shipment of the products by express couriers selected as necessary depending on the product ordered and the place of destination. The products are shipped by Miniconf S.p.a. and delivered by the courier selected by Miniconf S.p.a. to the address indicated by customers at the time of registration as set forth under art. 3 or to the different address indicated at the time the order is placed in accordance with art 7 above.
9.3 Miniconf S.p.a. undertakes to do its best to ensure that the products shipped pursuant to arts. 9.1 and 9.2 are delivered by the selected couriers within 72 hours from the date of shipment.
9.4The Delivery Terms as per art. 9.3, cannot, in any case, be considered binding and as Miniconf S.p.a. is not able to directly control the delivery of the products after their shipment, it cannot be held in any way responsible for non-compliance with said Terms.
9.5 To enable customers to monitor the status of their orders, Miniconf S.p.a. generates an order number. Inserted in the "My Orders" section, accessible from all pages of the On-Line Store, this makes it possible to check out all order-related information.
9.6 Customers are always able to verify the status of their orders through the online "Order Tracking" function provided by the courier selected by Miniconf S.p.a. for the delivery. Such verification can be carried out by the customer only after shipment of the products and using the tracking data communicated by Miniconf S.p.a. by email or by accessing the profile.
9.7 Customers, or other subjects delegated by the customers who find themselves at the address indicated for the delivery of the products in the order confirmation, are required to verify, at the time of delivery, that:
(i) the products correspond to what is indicated on the courier's Bill of Lading (BL) or transport document both by number and type;
(ii) the packaging/packing of the products is intact, not damaged, not wet or otherwise spoiled, including the closing materials.
9.8 Any damage to the packaging/packing of the products must be immediately reported by the customer by attaching a written control reservation on the courier's proof of delivery. It is understood that, once the courier's document has been signed without any objection, the customer may no longer raise any objection with Miniconf S.p.a. with reference to the external characteristics of the goods delivered.
9.9 Products may be delivered by couriers only to the customers or persons delegated by them; the person to whom the products are delivered must affix a signature to certify delivery. Couriers will not make deliveries to P.O. Boxes nor will they insert products in letter boxes or similar places.

10.Right of withdrawal

The right of withdrawal can be exercised by all customers, whether they have made the purchase as a guest or as a customer registered in the MyiDO section.
The non-registered customer who made the purchase as a guest may exercise the right of withdrawal within 14 working days of receipt of the goods using the following procedure:
1. the customer communicates his intention to make the return by email to customerservice@ido.it or by calling 0575/533444, specifying the order number and the items he intends to return;
2. The products must not have been used, worn, washed or damaged;
3. The products must be returned intact in their original packaging and with all tags and sent within 14 working days from the date of receipt to: iDO store, c/o Miniconf S.p.a, Magazzino Ferrantina 3, Zona Industriale Ferrantina, Via dell'Artigiano, 69, 52011, Bibbiena (AR), Italy.
4. Miniconf reserves the right not to accept damaged and/or used garments.
The cost of returning the product(s) to our warehouse by a customer not registered at www.ido.it is payable by the customer who is free to choose the carrier he prefers for the shipment. Only in the case of product faults attributable to Miniconf S.p.a. will the company reserve the right to assess whether or not to assume the cost of shipment.
If, on the other hand, the customer is registered in the MyiDO section and wishes to exercise the right of withdrawal, they may do so within 14 working days of receipt of the goods by carrying out the return procedure directly within their account. The customer can enter directly into their order, click on which item(s) they wish to return, book the return and print the return form to be inserted inside the package. When requesting a return, Miniconf S.p.a. invites the customer to indicate the reason for which they wish to return the product(s).
The return is free of charge only for customers registered in the MyiDO section and, in that case, after the customer has asked to withdraw by filling in the fields specified in the documentation that is to be found in their MyiDO account, it will be Miniconf S.p.a., that sends the courier.
Taking advantage of the free return paid for by Miniconf S.p.a., the MyiDO customer can request a goods exchange or close the return by receiving compensation equal to the value of the item(s) that the customer is returning or with a coupon equal to the value of the returned items. The coupon will not include free shipping costs.

In the case of an unregistered user requesting a change of merchandise, the new product/s will be shipped, at Miniconf S.p.a.'s expense, only after Miniconf S.p.a. has received the return and has verified its condition.
The cost of returning the product(s) to Miniconf S.p.a.'s warehouse by a customer registered in the MyiDO section is payable by Miniconf S.p.a. only if the customer complies with the returns procedure specified in the website www.ido.it and in these general terms of sale.
Shipping costs when exchanging goods are always at the expense of Miniconf S.p.a.
NB: some products are available in only one size/colour/length. Therefore, these products cannot be changed for a different size/colour/length etc.
If the customer, whether registered or not, does not want an exchange of goods, he can request a refund that will be made in accordance with the payment method used for the order or by issuing a coupon code that can be used for a new purchase at the Online Store.

11.Product flaws and defects

11.1 If products have any flaws or defects, these must be reported by customers directly to Miniconf S.p.a.
11.2 Customers are entitled to consumer rights as per art. 130 of Legislative Decree 206/05.(Consumer Code); these rights must be exercised within the terms set out in Article 132 of the same D. Lgs. 206/05.

12.Privacy

Miniconf S.p.a. declares and guarantees that customers' personal data will be processed in compliance with the provisions of Regulation 2016/679 and subsequent amendments and additions - GDPR and subsequent amendments and additions. Details relating to how data are processed are communicated to customers at the time of registration as per the previous art. 3.

13.Errors and/or inaccuracies in the Online Store

Miniconf S.p.a. is committed to constantly checking out the website www.ido.it in order to avoid errors or inaccuracies. It is, however, possible that the site www.ido.it contains, or may over time pick up errors, inaccuracies or omissions, some of which could refer to the price and the availability of the product, and its data sheet.

Miniconf S.p.a. therefore reserves the right to correct any errors, inaccuracies or omissions contained in the site www.ido.it even after an order has been placed and also reserves the right to change or update the information at any time without prior communication to customers.

14.Intellectual property

All intellectual property rights, such as trademarks and copyright, related to the Online Store (including content) are the exclusive property of Miniconf S.p.a.
The website www.ido.it and its content may not be reproduced in whole or in part, transferred by electronic or conventional means, modified, connected and used for any purpose whatsoever without the prior written consent of Miniconf S.p.a.

15.Applicable law and place of jurisdiction

15.1 The conditions for accessing the website www.ido.it and relations between the parties are governed by Italian law and must be interpreted in accordance with Italian law.
15.2 Customers accept the exclusive jurisdiction of Italian Courts. The Court of Arezzo will have exclusive jurisdiction regarding any action arising from or related to the General Terms of Sale, navigation and use of the site.

Shipping and Delivery

To guarantee fast delivery, the Miniconf S.p.a. online store can count on the best express couriers selected according to destination. The shipping cost will appear in the cart and will be added to the order total during the purchase process and will be charged at the time of payment. Nothing will therefore be due to the courier at the time of delivery, unless payment is COD.
Order processing
Orders are processed from 8.00 a.m. to 4.30 p.m. from Monday to Friday. Orders placed
after 3.30 p.m. on Friday will be processed the following Monday. Orders for available products will be filled within 3 working days after receipt of payment. All steps of the process and the status of the order will be visible in the customer’s personal account. To verify information relating to an order customers are invited to access their account in the “My orders" section.

Payments

The online store accepts payments via PayPal, credit card, MyBank, bank transfer and cash on delivery. The cash on delivery option is not available in case of deliveries to the point of sale. The customer will be able to choose one of these payment options at the end of the order process.
In no case can Miniconf S.p.a. accept cash payments, either directly or by post.
Please note: this online store operates from Italy and all transactions are carried out in euros (unless otherwise specified).

1 PayPal

PayPal allows any company or consumer with an email address to send and receive payments securely. By selecting the PayPal payment system customers access PayPal's secure site. Here, if they already have a PayPal account, they simply authorise the payment. If they do not yet have a PayPal account, after registering for free and providing credit card details (also a prepaid card, such as Postepay), they will be able to make payments to Miniconf S.p.a.

2 Credit card

Customers can pay in the iDO online store using credit cards belonging to the VISA, Maestro, Mastercard circuits and respective secondary circuits..
Payment is made on a secure server (SSL) with encryption key. Thanks to the advanced technologies used on the site user information and payments are always safe. We pay great attention to the security of the data transmitted and that's why we have chosen advanced payment systems. When a payment is made, the data are transmitted with a secure encrypted connection directly to the payment platform. For this reason ido.it is not made aware of any data related to the customer’s credit card. The HTTPS protocol and SSL certificate are present on this site. The HTTPS protocol (HypertText Transfer Protocol over Secure Socket Layer) protects the integrity and confidentiality of data. SSL (Secure Socket Layer) technology is essential for sites that require users to enter sensitive information or data necessary to authorise online payments. With this system all credit card details go directly to the bank in charge of taking payment on an encrypted and secure connection. No individual within Miniconf S.p.a. or on the Internet has access to customer credit card information at the moment it is submitted or at any other time. In their credit card statements customers will receive a charge specifying: "Miniconf S.p.a."The amount will be charged to the credit card as soon as Miniconf S.p.a. processes the order.
In the interests of credit card transaction security, customers will be asked to enter the secure code, failing which the transaction cannot be accepted.

3 Bank transfer

In the event of payment by bank transfer, customers must make the transfer to the bank indicated in the confirmation email, indicating the order number communicated by Miniconf S.p.a at the time of confirmation of same. The goods will be shipped only upon receipt of the payment confirmation.

4 Cash-on-delivery

If payment is by COD, upon arrival of the package, customers will pay the courier the amount of the order including shipping costs. This service has a surcharge of € 7.00.
It will not be possible to use the cash on delivery option for orders with delivery at the point of sale. For orders with delivery at the point of sale payment methods accepted in the Online Store are bank transfer, credit card, MyBank and Paypal.

RIGHT OF WITHDRAWAL AND RETURNS PROCEDURE

The right of withdrawal can be exercised by all customers, whether they have made the purchase as a guest or as a customer registered in the MyiDO section.
The non-registered customer who made the purchase as a guest may exercise the right of withdrawal within 14 working days of receipt of the goods using the following procedure:
1. the customer communicates his intention to make the return by email to customerservice@ido.it or by calling 0575/533444, specifying the order number and the items he intends to return;
2. The products must not have been used, worn, washed or damaged;
3. The products must be returned intact in their original packaging and with all tags and sent within 14 working days from the date of receipt to: iDO store, c/o Miniconf S.p.a, Magazzino Ferrantina 3, Zona Industriale Ferrantina, Via dell'Artigiano, 69, 52011, Bibbiena (AR), Italy.
4. Miniconf reserves the right not to accept damaged and/or used garments.

Customers can enter their order directly, click on which item(s) they wish to return, informing Miniconf S.p.a. of the reason why they intend to return it/them, book the return, print the form and insert it inside the package.
The return is free of charge only for customers registered in the MyiDO section and, in this case, after the customer has requested withdrawal by completing the fields specified in the documentation in their MyiDO account, Miniconf S.p.a. will send the courier. Using the free return at Miniconf S.p.a.'s expense, the MyiDO customer can request an exchange of goods or close the return with a coupon equal to the value of the item(s) that the customer returns or with a coupon equal to the value of the returned items. The coupon will not include free shipping costs.
If, on the other hand, a non-registered user requests an exchange of goods, the new product(s) will be shipped at Miniconf S.p.a.'s expense only after Miniconf S.p.a. has received the return and verified its condition.

The cost of returning the product(s) to Miniconf S.p.a.'s warehouse by a customer registered in the MyiDO section will be charged to Miniconf S.p.a. only if the customer complies with the return procedure specified on the website www.ido.it.
Shipping costs when exchanging goods are always at the expense of Miniconf S.p.a.
NB: some products are available in only one size/colour/length. Therefore, these products cannot be changed for a different size/colour/length etc.
If unregistered customers do not want to exchange goods, they can request a refund that will be made in accordance with the payment method used for the order or by issuing a coupon code that can be used for a new purchase at the Online Store.
